Alum James Harrington wins 8-0 decision by the U.S. Supreme Court in a case involving Tribal Immunity

Law Alum James M.Harrington L'10 of Polito & Associates, LLC experienced a huge win before the United States Supreme Court on  April 25, 2017 in Lewis et al. v. Clarke. The  8-0 opinion in his clients’ favor by The Court unanimously overruled the Connecticut Supreme Court which had previously ruled 7-0  against his clients in March 2016. The Connecticut Supreme Court had found that Attorney Harrington’s clients could not proceed against a Mohegan Sun limo driver because the driver was protected by the tribe’s sovereign immunity. Not so, according to the U.S. Supreme Court, which found that since the target of the personal injury suit involving a two-car accident was the Casino's limo driver, and not the tribe or a tribal office, therefore the tribe's sovereign immunity was not implicated.
